These Terms of Service ("Terms") govern your access to and use of Enigma Suite, operated by Enigmatech. Please read these Terms carefully before using our services.
1. Acceptance of Terms
By accessing or using Enigma Suite, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and customers of Enigma Suite.
2. Account Registration
To use certain features of Enigma Suite, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3. Subscription and Payment
Enigma Suite is offered on a subscription basis. Fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all applicable fees. All fees are non-refundable except as expressly set forth in these terms or required by applicable law. We reserve the right to modify pricing with 30 days' notice.
4. Acceptable Use
You agree to use Enigma Suite only for lawful purposes and in accordance with these Terms. You may not: use the service to transmit unlawful, harmful, or objectionable content; attempt to gain unauthorized access to any part of the service; use automated tools to scrape or extract data; resell or sublicense access without authorization; or use the service to violate any applicable laws.
5. Intellectual Property
Enigma Suite and its original content, features, and functionality are owned by Enigmatech and are protected by international copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms. You retain ownership of data you input into the platform.
6. Data and Privacy
Your use of Enigma Suite is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described therein. You retain all rights to the data you submit to the platform. We process your data as a data processor under your instruction and in accordance with applicable data protection laws.
7. Service Availability
We strive to maintain 99.9% uptime for Enigma Suite. Planned maintenance windows will be communicated in advance. We are not liable for service interruptions caused by events outside our control, including but not limited to natural disasters, internet outages, or third-party service failures. Enterprise SLA agreements are governed by separate agreements.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Enigmatech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
9. Termination
Either party may terminate these Terms at any time. You may cancel your subscription through your account settings. We may terminate or suspend your account immediately if you breach these Terms. Upon termination, your right to use the service ceases immediately. You may request an export of your data within 30 days of termination.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction based on your region of use. For customers in Mexico, Mexican law applies. For US customers, Delaware law applies. For Canadian customers, Ontario law applies. Disputes shall be resolved through binding arbitration.
